The Hendricks County Prosecutor's Office can offer traffic infraction deferrals in certain cases. For more information, read below.

HCPO INFRACTION DEFERRAL PROGRAM

The Infraction Deferral Program is offered by the Hendricks County Prosecutor's Office for infraction (non­ ordinance) cases only. If a Defendant complies with the conditions of the program and argument, the case will be dismissed, and notice of the violation is not sent to the Bureau of Motor Vehicles (BMV).

Not all infractions are eligible for the program. The eligibility requirements are listed below. If the Defendant meets the eligibility requirements for the program, he will be required to sign an agreement stating that he will not receive another violation for the duration of the contract. The length of the contract and cost vary depending on the type of infraction. The Defendant will not be required to pay the fine for the ticket if he signs up for the Infraction Deferral Program and pays the deferral fee.

If the Defendant qualifies for the program, he is mailed the deferral instructions and agreement. He must sign the Infraction Deferral Agreement and take it along with a certified check, money order, or cash to the applicable clerk or court office. If the Defendant does NOT qualify for the deferral program, then he is mailed a deferral denial letter. He must then either pay the ticket or contest it at trial.

A driver may NOT fail any of the requirements listed below in order to participate in the Infraction Deferral Program:

  1. Must not have been issued ticket within the past year.
  2. Must not have committed an alleged infraction in a work/construction/school zone.
  3. Must not hold a Commercial driver's license.
  4. Must not have been operating more than twenty (20) mph or more over the posted speed limit.
  5. Must not have two (2) or more moving violations within the past five (5) years.
  6. Must not have been convicted of Operating While Intoxicated in the past five (5) years.
  7. Must not have allegedly failed to yield to an emergency vehicle/school bus.

Eligibility is at the complete discretion of the Hendricks County Prosecutor's Office

***Town Ordinance Violations are not handled by the Hendricks County Prosecutor’s Office.

***If you are not a resident of Indiana, please attach your driving record.

DO NOT PAY YOUR TICKET UNTIL YOU KNOW IF YOU QUALIFY FOR A DEFERRAL.

If your infractions meet these requirements, complete the Infraction Deferral Request Form.  Send this form to the corresponding email below for the court in which your ticket is registered.
